JUST a few months ago a new board of directors was appointed to Right of Place, a charity for survivors of institutional abuse.

It was thought – and hoped – this would bring an end to the secrecy, unanswered questions and allow for a full airing of the facts, and an investigation into past actions which had seriously concerned members.

However, it has become clear this is not going to happen, and rather than facilitate this, the HSE seems happy to sweep it under the carpet.

Right of Place has been mired in controversy since last year when this paper revealed funding was not filtering down to the membership.

Now with the resignation of two of the new board and ongoing reticence from the HSE to investigate, it seems the only way forward is for the Public Accounts Committee to finally bring all the facts and figures together.

Abuse survivor Tom Brennan, stood down after just two months as the elected treasurer, as he maintains he was not comfortable presiding over the finances of an organisation with so many unanswered questions.

To say Right of Place in Cork has “unanswered questions” is putting it mildly.

Since last December this paper has repeatedly put those questions to the HSE, which funds Right of Place, and in the public domain.

Still no answers are forthcoming. Not even for the financial controller it seems. According to Mr Brennan he came up against an unwillingness to answer questions and an apparent lack of concern about finding out how millions of euro of taxpayers money was spent over the years.

“Looking at all the money which has been spent over a 10-year period I asked for a written record of who benefited, what was achieved and what the plan was. I asked the project leader Noel C Barry and was promised the information but I never received it,” Mr Brennan said.

“Every business has a business plan and upon that you can say fail, achieved or whatever the case may be.

“Apart from people who benefited from wages, meals, travel expenses, rent and the very small number of people who lived in Welcome House and Right of Place, there is absolutely nothing to show that anybody benefited from it.”

Examining the payroll system, Mr Brennan discovered there was four people who were being paid by cheque and not through the payroll system.

There was one employee out on long-term illness but who is still being paid – though again not through the payroll system so he could not see how much he was getting, and another man living in London getting €400 a week for running an office from his house where it is claimed he is running an advice service.

“I asked what this man had achieved over the years, what did he do, what progress had he made and I was told he repatriated three people.

“I told Mr Barry I wanted to see all the employee files. I asked that expenses had been drawn down, what entitlements were, who was out sick. On three occasions he was to have the information for me but it never materialised. He could not tell me how many people were employed there. I asked to see a database of membership, it never materialised.”

Mr Brennan then asked about an accountant.

“I met with the accountant who raised concerns. They said normally they charge €1,500 to €2,000 for an audit but for this year it was so complex it would be more than €10,000.”

A letter from the accountants to Right of Place, seen by the Irish Examiner, asks for copies of travel expense claims, purchase invoices, details in relation to cheque payments, copy of receipts in relation to petty case payments for 2009 and details of members assistance paid to individuals, among other things.

According to Mr Brennan, although Mr Barry had walked into a meeting one day and quit his post, it was later asked decided he should be allowed to “retire” rather than resign.

“This means he gets all his entitlements, I asked how could we let someone who had presided over this mess go away with a lump sum and a pension.”

At this stage, Mr Brennan was seriously considering about his own position.

“I was totally and utterly frustrated. I took legal advice and was advised by my solicitor to get out.

“I put it to the new board that if we did not get to the bottom of all of this then as the directors of a charitable organisation we could be held financially liable. My own solicitor told them this and they still would not believe it.”

According to Mr Brennan, the awkward questions he was asking were not going down well and it was about this time that his travelling expenses began going missing.

He saw this as a subtle but clear sign that he was to desist from trying to get to the bottom of things.

Did the HSE ever ask any of these very pertinent and important questions?

“I don’t know,” Mr Brennan said, “the HSE was very vague.”

Indeed, repeated requests to the HSE for answers simply refers the matter to the board, although this paper understands the HSE is only too aware of what is going on.

Of course, the underlying question, is why all of this was allowed to carry on for so long.

    Mossie, Twice in the last 12 month’s I have contacted ROP, the first was to Mr Barry, to request he remove my detail’s from his data base. That was ignored, until recently, I received the same letter as you got, from a Mr Walsh, informing me that he was the new Chairman, and had a new committee,none of which I knew, or was invited to vote for. So I sent him the same letter I sent to Mr Barry, asking him to remove my detail’s and not to contact me again. I advised him also that copies of that letter were being sent to the Dept. of Education, the HSE in Cork, and to the Irish Newspaper’s. I further gave my reason’s for this to all concerned, in that in my opinion this Group, were set up illegally, were not mandated, and have no right to solicit funding on the back’s of member’s they no longer have, with many , that i know for a fact, have passed on, and many like myself, who resigned from this group! and the previous group!

    My advice to folk who are in the same boat, to write or email the above named Dept’s and the Newspaper’s to give their view’s and comment’s.

    Letter’s to ROP re not answered, but they will try to carry on using folk’s name’s to keep the funding coming for their own benefit.

    YOU ARE SO RIGHT THERE JIMMY. I ALSO HAD PROBLEMS WITH MY NAME AND DETAILS BEING REMOVED, EXCEPT, I GOT BACK A SIGNED LETTER REPLY FROM MR BARRY, IN PERSON, CONFIRMING THAT MY DETAILS HAD BEEN REMOVED FROM HIS DATA BASE.

    ONLY TO RECEIVE MORE CORRESPONDENCE A COUPLE OF WEEKS LATER FROM RIGHT OF PLACE. IF MY DETAILS HAD BEEN REMOVED FROM THAT DATA BASE, I WOULD NOT HAVE RECEIVED THAT CORRESPONDENCE FROM THEM.

    SO I MADE AN OFFICIAL COMPLAINT TO THE FREEDOM OF INFORMATION, WHO TOOK UP THE CASE FOR ME, AND THEY CHALLENGED RIGHT OF PLACE, WHO MADE UP SOME SILLY EXCUSE TO WRIGGLE THEIR WAY OUT OF IT, BUT IM FULL SURE IT’S DONE NOW.

    MR WALSH IS SUPPOSED TO BE THE NEW CHAIRPERSON IN THERE AT PRESENT. HOW HE GOT TO BE CHAIRMAN IS A TOTAL MYSTERY. HE WAS NOT ELECTED BY US, BUT WE ARE SURE HE SPEAKS ON BEHALF OF MR BARRY, AND CO, SO THAT ALONE SPEAKS FOR ITSELF.

    DID YOU NOTICE, JIMMY, WHEN YOU RECEIVED THAT LETTER FROM MR WALSH, HOW MANY OF THE NEW BOARD OF DIRECTORS SIGNATURES WERE ON THAT DOCUMENT????????? I BET ONLY MR WALSH”S SIGNATURE WAS THE ONLY SIGNATURE ON THAT LETTER. EVER WONDER WHY????????

    IT JUST GOES TO SHOW, THE REST OF THE BOARD OF DIRECTORS DID NOT AGREE WITH THAT STATEMENT, IN THAT LETTER. MR WALSH IS DOING ( EXACTLY ) AS MR NOEL BARRY WAS DOING. THE BOOK STOPS WITH HIM, AND MR WALSH WAS , AS MR BARRY DID, ( SPEAKING FOR HIMSELF ) NO ONE ELSE.

    SO I AM NOT SURPRISED TO HEAR YOU SAY, JIMMY THAT YOU HAVE NEVER HEARD OF THIS MAN, MR WALSH, BECAUSE I CAN ASSURE YOU, A LOT OF OTHER PEOPLE NEVER HEARD OF HIM EITHER. HE WAS PUT IN THERE IN MY OPINION BY, THAT FELLA TREANOR, ( SO CALLED BARRISTER ) AND SPOKESPERSON FOR MR NOEL C BARRY.

RETAINING YOUR DETAILS, IS GIVING THEM AUTHORITY TO ACT ON YOUR BEHALF, AND GET FUNDING FROM THE DIFFERENT SOURCES.

    Hi William, Good idea, but i would think the way thing’s are at ROP,it is very unlikly that anyone will receive a Christmas card, i was a member for many year’s, from when it first started up, and never once received a card, and was not surprised that my request to remove my name from their data base was ignored over 12 month;s ago, when it became apparent to me that the running of the site was subject to all sort’s of allegation’s, and the event’s that followed.
    The letter i got from a Mr Walsh a couple of month’s ago, indicating that he was the new Chairperson, and had a new committee up and running, and asking me to give them time to get their Brand New Outfit sorted out, amazed me, as i had never heard of this man, or any of the new committee guy’s! I wrote back and requested that my detail’s be removed from the mailing list that fell into his hand’s, and assured him that he does not represent me! I had no wish or desire to go from the frying pan into the fire! Especially with a group that i see as illegal, not elected or mandated.
    If your idea of ROP sending out 1500 Christmas card’s to the member’s they claim they have, i would be surprised if in fact the HSE would get beyond a dozen back!
    As for what help i ever got from them, NONE!
    THEY HELPED THEMSELVE’S!

    A SUPPORT group for victims of clerical abuse that has received more than €3million from the taxpayer has admitted it has no idea where the cash has gone. The charity is now in the extraordinary position of asking anyone who has ever made a donation or received its help to get in touch so it can work out exactly how much money has gone missing.

    The bizarre move comes after the HSE stepped in to appoint a temporary administrator to run Right of Place/Second Chance, which is carrying out a full investigation of its finances. Tom Wall, a director of the Cork-based charity, said last night: ‘As bad as it sounds, we simply do not know exactly how much money the charity has received. And, more worryingly, we don’t know what it has done with the money.

    ‘I would urge anybody to get in touch with us and let us know how much money they gave us and when.’He added: ‘There is a feeling at the charity that in the past it has not always acted in the best interests of its members and that is very regrettable.’

    Tom Cronin, a survivor of institutional abuse at Presentation Brothers’ Greenmount Industrial School in Cork who helped set up the group in 1999, welcomed the internal audit, which he has been demanding since 2006.

    He said last night: ‘Just who actually benefited from this charity is still something of a mystery. That is an outrageous situation and it has gone on for far too long.

    ‘I am delighted that the board are taking such a bold and innovative step as part of their determination to re-structure the charity. I think it’s now just a matter of time before the gardaí are called in.’

    Mr Cronin, who resigned from the board of directors in 2001, accused the Government of handing over vast amounts of Exchequer money for more than 10 years without bothering to find out where it was going.

    ‘The various departments who have given money to this charity have, in my opinion, being a bit relaxed when it comes to checks and balances,’ he said.‘

    The Irish Daily Mail has learned that between 2001 and 2008 the Department of Education gave a total of €980,080 to Right of Place, which claims to represent 1,500 people.

    A further €677,000 was received from the Department of Health between 2002 and 2005. Between 2006 and 2010, the HSE – which took over funding for the charity from the Department of Health – gave €1,498,723.
    Noel Barry, the organisation’s founder and a victim of abuse at the Rosminian school at Upton, Co. Cork, resigned last month following attempts to oust him. He has always refused to comment on the situation.
    Mr Barry went to the High Court last year to apply for an injunction against a committee of members who were trying to wrest control from him. Meanwhile, the HSE said it would provide no more public money unless his organisation proved it could handle it responsibly.

    On top of the €3.1million in direct government funding, the charity also received €50,000 Lotto funding in 2003. Controversially, it also accepted money from some of the very religious orders that ran institutions accused of
    abusing the people it claims to help. The exact amount the various organizations gave is not publicly known but it is estimated at €300,000. The Sisters of Mercy in Cork gave at least €20,000 but by last year they were demanding to know how the money was actually being spent.

    In 2009, Sister Maria McGuinness from St Columba’s Convent in Cork wrote to the charity saying: ‘I would be grateful to receive the detailed breakdown of how the grant of €20,000 was spent.’

    Other orders include Brothers of Charity, which gave €5,000 in 2000, the Sisters of Charity, which gave €10,000 in 2006, and the Congregation of the Brothers of Charity. The Galway-based charity donated €6,350 in 2002. The Rosminians Institute of Charity in Drumcondra, Dublin, donated €5,000 the previous year.

    The HSE last night denied ignoring how Right of Place administered tax-payers’ money. A spokesman said: ‘During the period December 2009 to date, the HSE has worked with the organization to bring about structure and good governance.

    ‘In May 2010 all parties signed an agreement which created a pathway to move forward. It provided a mechanism to democratically elect a new board of directors representative of the local committees of the organization.’

    She said the HSE would not be able to give details about its funding plans for Right of Place next year until the Budget has been announced. Mr Wall said: ‘We are currently going through a major restructuring process. A major part of that is a detailed look at the charity’s finances.’

    now it seems there is going to be an election all survivors need to remember how we have being treated by the government ? and there followers in the criminal church, it is now possible that the new government will deal with the groups that are getting all our money to account for what they done with it.anyone that wants paddy to become the spokesperson for the victims will have to stand by him fully there are a lot of people that want the same shit to go on as before.they wont lie down they are having it to good,read about fr.masterson he was in ferryhouse with me as a child, one of the prefects not surprised he went on to be an abuser,good news i now blacklisted in twelve sights

    This was done yesterday afternoon after my offer here; I have not announced it as I have not managed to get all the aims and objective up for ratification, due to a technical difficulty!

    I was going to spend this weekend recruiting Members for the purpose of reaching a core Membership worth Representing i.e. The more people you are Mandated to represent the more credible the Mandate!

    As I have said in the past and still maintain the “Shame of Ireland” website belongs to the Members not me! (This is even truer as it was a gift to the Members).

    The reason for this Gift was my vision of “Democracy Transparency and Inclusion” for all survivors of the Industrial Schools.

    Shame of Ireland is Unmoderated and will remain that way, as i will not ell members what they can or can’t say, or can or can’t do! (Just be aware that you are legally liable for your postings).

    My only concern with running this election outside the confines of a distinct Membership is that the Numbers Represented can go up as well as down so can be challenged by anyone at any time?

    The Difficulty of Canvassing opinion on specific issues, where not all those Represented agree? We are then in a “because I say so” situation and I for one would never want to put Paddy in that position??

    If you want to do this through an external Petition Site I will set it up for you. However this will not have the same effect of the Live Voting that cann offer a rolling Mandate reaffirmed at any time on any Topic?

    I have and will continue to Recriut Members so the we can have a credible core to represent.

    Kay, you directed me to here, and i thought i was looking for somewhere to sign my agreement for a mandate for to have Paddy as spokesman for us. Cant find, where to sign, but i do agree, big time, with Paddy being the Man for the job.
    Hopefully we will get there in the end.

    One further point, i only learned today ,via this site, that the Contribution’s made by the Religious, are subject to condition’s, that the Proposed Trust Fund is set up by the Government. This is so wrong, as it seem’s the Religious want to add insult to injury now. And further Abuse us in our old age!
    I feel so daft now, and sick at these antic’s of the R/C/Church, especially as i had been guilty of allowing them some credit for their apoligy, and their contribution, and honestly thought the Basket’s were making an effort to put their house in order!

    How wrong i was, seem’s they are as ABUSIVE as ever! Their right up there with the RIRB, AND THE PHONEY GROUP’S, NOT TO MENTION THE FECKLESS GOVERNMENT.

  19. I AM SICK AND TIRED OF HEARING ABOUT THE GROUPS, THESE PEOPLE WORK FOR THE IRISH GOVERNMENT AND HAVE FROM THE START THEY PAY THE WAGES. THE EXCEPTION TO THAT IS john Kelly as far as i know he never received one penny now why do you think the government are so willing to give them all this money maybe it is because they helped sell the redress board or is it possible that the HSE has a lot more to hide anyway paddy you have my blessing to represent me and my friends.if the trust fund is forced on the victims,it should be used to prosecute the Irish government and the criminal church then we would see how many lawyers would come running to represent the victims not many i think.Anyway good luck PADDY

    Kay, I’ve long held the belief that the various and disparate groups should be done away with. It’s clear from this website that not ONE single person that has written to it wants them to exist, with the exception of women’s support groups/networks in the UK.
    With regard to the groups in Ireland many people have heard of them but never heard from them. Emails and letters go unanswered. Phone calls made to various numbers are not answered and if they are it is via an answering service.
    I’ve no idea as to where we go from here Kay. Getting these groups closed down is not going to be easy, power can be a drug, a powerful drug and people become addicted to it.
    If you can find out who this person that’s allegedly earning €400 a week. Perhaps you would email me his or her name.
    Yes, I would consider being a spokesperson for people who were abused while in the care of religious orders and the State subject to people wanting me to be just that person and having a clear mandate to speak on their behalf.

    Well said Paddy, like Jimmy, Bill and no doubt many others, I also received a letter from the new face of the R.O.P, I threw it straight in the bin where it belongs, but for the life of me I just don’t understand why this has been allowed to carry on for as long as it has!

    Who is this man? This advice service was never mentioned in any letters from the R.O.P, not to me anyway living in the U.K.

    Mr Brennan did the honest and sensible thing in getting out and letting others know of the disgraceful goings on.

    Where do we go from here Paddy? How do we get these groups closed down? I know it’s a lot to ask of you Paddy but would you please consider being spokesperson for us on this matter and also on the proposed Trust Fund.

  26. these groups cause harm to all of us. thay have turned many survivers against each other and thats negatif for all of us. if people want to form groups that is thier own buisness.but thay should do it privately. as things are the majority are paying for a minority. there is no justice in that .
